Producer [PPWR definition]
In Dutch context: The manufacturer, importer or distributor who, irrespective of the selling technique used (including distance contracts), makes available for the first time from within the territory of a Member State a packaging¹ or packaged product², or who sells these to end users (of the product) in the Netherlands.
- 1: transport packaging (including e-commerce), service packaging, or primary production packaging.
- 2: all other packaging.
Exception: When a fulfilment service provider unpacks and re-packs and redistributes products, and the commissioning company isn’t the producer, the fulfilment service provider takes over the role of Producer.
Example of exception: You are the producer if, as a fulfilment service provider commissioned by another company, you unpack and repack clothing in another country to ship this clothing to various countries. In this case, no manufacturer, importer, or distributor can be found in the Netherlands for the unpacked packages, and the fulfilment service provider is the producer.
